OmniStore Acceptable Use Policy

0. Purpose and scope

This Acceptable Use Policy (the “AUP”) sets out the conduct and content rules every OmniStore Merchant, Team Member, and Customer is expected to follow. It is part of, and incorporated into, the Terms of Service at useomnistore.com/legal/terms; breach of the AUP is breach of the Terms of Service.

We adopt this AUP because OmniStore is a multi-tenant platform: one Merchant’s misuse can compromise the security, reputation, or legal standing of other Merchants who share the same infrastructure. Most of the restrictions in this AUP exist to protect every Merchant equally.

Capitalised terms not defined here have the meaning given in the Terms of Service.


1. Prohibited content

You may not use the Platform to upload, store, list for sale, transmit, advertise, or otherwise make available any of the following categories of content.

1.1 Illegal goods and services

  • Anything whose sale or possession is illegal under the law of Cameroon, the law of the jurisdiction where you operate, or the law of the jurisdiction where your buyer is located. This includes (without limitation) narcotics outside their legal channels, stolen property, smuggled goods, counterfeits, and items whose sale is restricted to licensed sellers (you do not hold the licence).
  • Anything subject to applicable sanctions regimes (UN, EU, US OFAC, or Cameroonian sanctions) where the sale is prohibited.

1.2 Regulated substances

  • Tobacco, nicotine, e-cigarettes, vaping products, and accessories, except where the Merchant holds the licences required to sell them in the buyer’s jurisdiction and complies with applicable age-verification, advertising, and labelling rules.
  • Alcoholic beverages, except where the Merchant holds the licences required and complies with age-verification rules.
  • Prescription medications, controlled substances, and pharmacy products outside the legal channels of distribution.
  • Cannabis, CBD, and related products: prohibited on the Platform regardless of local legality, because of the substantial cross-jurisdictional risk. This is a policy decision OmniStore has made for the present launch; it may be revisited as the legal landscape stabilises.

1.3 Weapons and related items

  • Firearms, firearm components, ammunition, and high-capacity magazines.
  • Explosives, fireworks, and pyrotechnics outside licensed retail channels.
  • Knives marketed for violence (including switchblades, gravity knives, and ballistic knives where prohibited).
  • Tasers, stun guns, and similar electroshock weapons where prohibited.

Note: kitchen knives, tools, hunting and fishing equipment that comply with applicable law are permitted.

1.4 Sexual exploitation and minors

  • Any content sexualising or sexually exploiting a minor under any circumstances. This includes images, video, written material, and any product whose advertising or use sexualises a minor. We report such content to law enforcement.
  • Non-consensual intimate imagery (“revenge porn”).
  • Content depicting unlawful sexual violence.
  • Any item or service that facilitates child trafficking, forced labour of minors, or other serious harm to children.

1.5 Adult content

  • Pornographic content (still images, video, written, or audio).
  • Adult-product retail (sex toys, fetish equipment) is permitted subject to applicable law and to the same age-verification rules that any other restricted product is subject to, and provided that product imagery is not pornographic. We may require Merchants in this category to enable additional age-verification controls.

1.6 Hate speech and incitement

  • Content that promotes or incites violence, discrimination, or hatred against individuals or groups on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any other protected characteristic.
  • Symbols or imagery of designated terrorist organisations or hate groups, where used to promote those groups.
  • Content that glorifies acts of terrorism or mass violence.

1.7 Fraud and scams

  • Items advertised in a misleading way (price-bait, photo-bait, false claims about origin, false health claims, false ingredient lists, etc.).
  • Counterfeits, replicas, or imitations of branded goods sold without authorisation.
  • Schemes that solicit payment for goods or services that will not be delivered as described.
  • Pyramid schemes, multi-level marketing structures whose primary revenue comes from recruitment rather than product sales, and similar.
  • Goods bought with stolen payment instruments or otherwise obtained through fraud.

1.8 Privacy violations

  • Content that publishes private personal information of others without their consent (doxxing).
  • Lists of personal data of identifiable individuals (email lists, phone-number databases, address books) offered for sale.
  • Content that infringes another person’s reasonable expectation of privacy.

1.9 Animals

  • Live animals; endangered species, animal trophies, ivory, or other items prohibited under CITES.
  • Pet products that involve cruelty (devices designed to cause pain to animals).

1.10 Intellectual-property infringement

  • Content that infringes another person’s copyright, trade mark, patent, or trade secret. The DMCA / Copyright Policy at useomnistore.com/legal/copyright describes the takedown procedure.
  • Bootleg, pirated, or unauthorised copies of music, film, software, books, games, or other copyrighted works.
  • Counterfeit goods bearing another person’s trade mark.

1.11 Malware and exploit tooling

  • Software, scripts, or services intended to gain unauthorised access to computer systems, including malware, ransomware, viruses, exploit kits, and credential-stealing tooling.

1.12 Other

  • Content that is otherwise unlawful under the law applicable to the Merchant or to the buyer.

2. Prohibited conduct

In addition to the content restrictions above, you must not engage in any of the following conduct using the Platform.

2.1 Impersonation

  • Impersonating any person or entity, including OmniStore, our subprocessors, our staff (Harold Voufack), other Merchants, public officials, or law-enforcement officers.
  • Misrepresenting your affiliation with any person or organisation.
  • Using another person’s identity, photo, or signature in your store branding without their authorisation.

2.2 Harassment and abuse

  • Harassing, threatening, stalking, or intimidating any other Merchant, Team Member, Customer, OmniStore staff, or subprocessor staff, whether through Storefront content, support channels, social media, email, or any other channel.
  • Encouraging others to do the same.

2.3 Spam and unsolicited commercial messaging

  • Using the Platform to send unsolicited bulk email, SMS, or any other unsolicited commercial message.
  • Using our email-sending infrastructure (transactional templates, password-reset flows, etc.) to deliver content that is not transactional in nature.
  • Using our SMS top-up rails to deliver SMS spam.
  • Sending automated direct messages from your Storefront’s contact features to unrelated third parties.

2.4 Platform abuse

  • Probing, scanning, or testing the vulnerability of any OmniStore system or network without our prior written authorisation. Co-ordinated, in-good-faith security research is welcome under a responsible-disclosure process; contact legal@useomnistore.com to coordinate before testing.
  • Attempting to bypass or defeat any access control, role gate, rate limit, tenant isolation, or audit-logging facility of the Platform.
  • Attempting to access another Merchant’s data, sessions, or administrative surfaces, including through enumeration of identifiers, manipulation of cookies, or exploitation of any vulnerability.
  • Operating the Platform under multiple Accounts to circumvent quotas, trials, billing, or enforcement actions.

2.5 Automated access

  • Scraping, crawling, or programmatically extracting data from the Platform at rates that disrupt other tenants or the operation of the Platform.
  • Using the Platform’s APIs in ways that materially exceed the documented rate limits or usage tiers.
  • Generating fake load, fake sales, fake customer accounts, fake reviews, or other fake activity for any purpose (testing your own integration is permitted in a non-production environment we may provide).

2.6 Network abuse

  • Using the Platform to host content used in coordinated denial-of-service attacks against third parties.
  • Routing traffic through the Platform to evade IP-based access controls of third parties (using the Platform as a proxy or relay) unless we have explicitly authorised it.
  • Hosting open-relay mail forwarders, open proxies, or anonymising services.

2.7 Tax and regulatory evasion

  • Using the Platform to evade taxes, customs duties, or other regulatory obligations applicable to your business.
  • Misrepresenting the location of the buyer or seller in transactions for the purpose of regulatory evasion.

2.8 Money laundering and terrorism financing

  • Using the Platform to launder the proceeds of crime, to finance terrorism, or to evade applicable anti-money-laundering laws.

2.9 Misuse of personal data

  • As a Merchant who is a data controller of your Customers’ personal data, you must comply with applicable data-protection law (GDPR, CCPA, Cameroonian Loi N° 2010/012, etc.). Misuse of Customer personal data - e.g. selling it to a third party without consent, using it to harass Customers, exposing it through a misconfigured Storefront - is a breach of this AUP.
  • Importing Customer lists you did not lawfully obtain (e.g. scraped from third-party sites) into the Platform is a breach of this AUP.

3. Enforcement

OmniStore enforces this AUP through a graduated remedy schedule. The remedy applied depends on the severity of the breach, the harm caused, and whether the Merchant has prior breaches on record. Severe breaches (Section 1.4 minors, Section 2.8 money laundering, Section 1.11 malware distribution, etc.) skip the graduated remedies and go straight to suspension or termination.

3.1 Warning

For minor or first-time breaches, we may send a written warning to the Account email describing the breach and the corrective action expected. The warning is recorded in the Account’s audit log. If you cure the breach within seven (7) days, no further action is taken; the warning remains in the audit log.

3.2 Content removal

We may remove, hide, or disable any Content that violates this AUP. Where the removal affects a published product page on a Storefront, the page is replaced with a generic “currently unavailable” placeholder; we do not publicly attribute the removal to a breach.

3.3 Suspension

For breaches that do not justify termination but cannot be cured promptly, we may suspend the Account or specific features (e.g. ability to publish new products, ability to use SMS sending). A suspended Account retains read access to its data; write operations are gated.

3.4 Termination

For severe breaches, repeated breaches after warnings, or breaches that pose ongoing harm, we may terminate the Account under Section 11.3 of the Terms of Service. Termination is final; the Account is closed and any pre-paid Fees are non-refundable (Section 11.5 of the Terms of Service).

3.5 Referral to authorities

For breaches that are likely to constitute criminal offences (child sexual exploitation, terrorism, money laundering, large-scale fraud), we may report the breach to law enforcement and provide any evidence we hold, subject to applicable law.

3.6 Cooperation with court orders

We comply with valid court orders and law-enforcement requests properly issued under the law of a jurisdiction with authority over us. We challenge improper requests and, where legally permitted, notify the affected Merchant before complying.


4. Appeals

If you believe we have applied an enforcement remedy in error, you may appeal.

4.1 How to appeal

Send an email to legal@useomnistore.com from the Account email, with subject “AUP Appeal - [Account email]”, within fourteen (14) calendar days of receiving the enforcement notice. Describe:

  • The remedy you are appealing.
  • The basis for the appeal (e.g. mis-identification, false-positive on a Content scan, mitigating circumstances).
  • Any evidence we should consider.

4.2 Review

Harold Voufack personally reviews AUP appeals and responds within ten (10) business days. The outcome of the appeal is one of:

  • Uphold: the remedy stands.
  • Reverse: the remedy is lifted. Where reversal restores access (e.g. unsuspension), we do so promptly. Where the breach involved Content removal, we restore the Content unless doing so would create a further breach.
  • Modify: the remedy is adjusted (e.g. from suspension to warning).

4.3 No appeal for severe breaches

Appeals are not available for breaches of Section 1.4 (sexual exploitation of minors) or for breaches where the response is mandated by court order or law-enforcement request.


5. Reporting AUP breaches

If you become aware of a breach of this AUP by another Merchant or by anyone using the Platform, report it.

5.1 How to report

Email legal@useomnistore.com with subject “AUP Report - [URL or store slug]”. Include:

  • The specific URL, store slug, product, or other identifier of the suspected breach.
  • The category of breach (referring to Section 1 or 2 of this AUP).
  • Any evidence (screenshots, URLs, timestamps).
  • Your contact details (we may need to follow up).

5.2 Privacy of reporters

We do not publicly identify the reporter of an AUP breach. We may identify the reporter if compelled to by court order. Anonymous reports are welcome but we may be unable to follow up.

5.3 Bad-faith reports

Submitting AUP reports in bad faith (knowingly false, malicious, or for the purpose of harassing a competitor) is itself a breach of this AUP.

5.4 Future in-app reporting form

An in-app reporting form is planned. Until it ships, email is the reporting channel.


6. Indemnification

Your breach of this AUP triggers your indemnification obligation under Section 10.1 of the Terms of Service: you are responsible for any third-party claim arising from your breach, including legal fees we incur in defending against it.


7. Relationship to other policies

This AUP focuses on what you may not do on the Platform. The other legal documents cover other aspects:

  • Terms of Service (useomnistore.com/legal/terms): the overall contract.

  • DMCA / Copyright Policy (useomnistore.com/legal/copyright): the takedown procedure for copyright claims.

When this AUP conflicts with another OmniStore policy or with the Terms of Service, the more restrictive provision applies to the prohibited-conduct topic at hand.

Changes to this AUP

We may update this AUP from time to time. Material changes will be communicated to OmniStore account holders by email and through the in-app banner at least 30 days before they take effect. The current version, effective date, and change summary appear at the top of this page.
